As the Data Controller, SMARTES TEKNOLOJİ YAZILIM DANIŞMANLIK SAN. TIC. LTD. ŞTİ. we take the utmost care to protect the security of personal data, especially the privacy of your personal data, and to safeguard fundamental rights and freedoms while carrying out our activities.

With this Information Notice, we inform you about the methods of collection and transfer of your personal data, the purposes of processing, the legal grounds, and your rights in accordance with the provisions of the Personal Data Protection Law No. 6698 (‘KVKK’). This Information Notice has been prepared for real persons who send us messages containing questions/requests and complaints by filling out the contact form on our website.

Data Controller

In accordance with the KVKK, your personal data will be processed by our company, which is established as a limited company in accordance with the laws of the Republic of Turkey and continues its activities, as the data controller, within the scope explained in this Information Notice.

Personal Data and Processing of Personal Data

Any information that makes you identifiable or identifiable in accordance with the KVKK constitutes your personal data. Data related to a person’s race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, attire, membership in associations, foundations or unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data, constitute special category personal data.

The processing of your personal data refers to any operation performed on such data, including the collection, recording, storage, retention, alteration, reorganisation, disclosure, transfer, acquisition, making available, classification, or restriction of use of such data, in accordance with the KVKK.

The personal data processed by us as the data controller includes your identity information (name and surname), contact information (phone number, email address), the name and title of the company you work for, your country, city, and the message you wish to send.

Purpose of Processing Personal Data

Your personal data mentioned in this Information Notice may be processed and transferred for the purposes of managing requests and complaints related to products for which sales/maintenance or support services are provided, answering any questions you may have about goods and products, and continuing promotional and marketing activities.

Your personal data is processed in accordance with the principles of compliance with the law and good faith, accuracy and, where necessary, keeping up to date, processing for specified, explicit and legitimate purposes, processing in a manner that is adequate, relevant and limited to what is necessary for the purposes for which they are processed, and retention for the period required by the relevant legislation or for the purposes for which they are processed.

Method and Legal Basis for Collecting Personal Data:

Your personal data is collected through channels such as our head office, our website, and through other channels, whether physical or electronic, and by any other means, whether automatic or non-automatic, and through other channels through which our Company communicates with you or may communicate with you in the future, in order to carry out our activities.

The personal data collected for this legal reason may be processed and transferred within the framework of the personal data processing conditions and purposes specified in Articles 4, 5 and 6 of the KVKK for the purposes specified in this Information Text. The legal grounds for processing are as follows: The processing of your personal data is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract (e.g., providing support upon your request regarding the use of machinery in accordance with the signed Agreement), The legitimate interest of the data controller (e.g., keeping records of complaints directed to us in order to improve our activities as a result of requests and complaints), Your explicit consent, where required (e.g., processing your data in cloud computing systems and transferring it abroad)

Transfer of Personal Data:

Your personal data collected will be transferred to the overseas business partner of SMARTES TEKNOLOJİ YAZILIM DANIŞMANLIK SAN. TIC. LTD. ŞTİ., its shareholders, and the relevant department responsible for the issue, in accordance with the legislation and the Company’s Internal Policies and Procedures, and for the other processing purposes specified in this Information Notice. SMARTES TEKNOLOJİ YAZILIM DANIŞMANLIK SAN. TIC. LTD. ŞTİ. may transfer your personal data to its foreign business partners, shareholders, and the relevant department responsible for the issue, in accordance with the personal data processing conditions and purposes specified in Article 8 of the Law.

iii. Learn the purpose for which your personal data has been processed and whether it has been used in accordance with that purpose,

iv. Know the third parties to whom your personal data has been transferred within or outside the country,

v. Requesting the correction of your personal data if it has been processed incorrectly or is incomplete,

vi. Requesting the deletion or destruction of your personal data,

vii. Requesting that your requests for correction, deletion and destruction be communicated to third parties to whom your personal data has been transferred,

viii. Objecting to the emergence of a result against you through the analysis of your processed data exclusively by automated systems,

ix. You have the right to request compensation for any damage you may suffer as a result of the unlawful processing of your personal data.
